The British Boxing Board of Control insist no decisions will be made about the title of WBO featherweight champion Scott Harrison until it is officially confirmed he has been released from prison.
The 29-year-old is set to be bailed from a Malaga jail on Monday, according to his manager Barry Hughes.
The Cambuslang fighter has been behind bars since October 6 after an alleged assault.
Hughes had expected Harrison to be released on Saturday but the Spanish judge dealing with his case was not available to sign the relevant paperwork.
Now Hughes will re-present documents to allow the boxer to be freed on Monday.
But the BBBC maintain his proposed title defence against Nicky Cook, which is scheduled for December 9 at the ExCel Arena in London, rests with a number of key figures, most notably Harrison himself.
BBBC general secretary Simon Block said: "What is essential in the case of Scott Harrison is: Is he in or is he out (of prison)?
"If he is out, is he in a fit state to continue his career and, if he is not right now, when will he be - if ever?
"So there are a number of questions about Mr Harrison which have to be resolved when he is out.
"And, obviously, the answer to those questions cannot be tackled until he is in a position to tackle them."
Initially, Harrison was due to have undergone a BBBC medical on Monday to determine his fitness for the title defence against Cook.
But Block maintains there are further hurdles to negotiate before the governing body can intervene.
He said: "A boxer can prove his fitness at any time. What is relevant is the December 9 situation.
"It was proposed he defend his championship on that date. There are a number of factors now relating to that.
"Firstly, does promoter Frank Warren still want to put the fight on?
"Number two is the question whether he is still champion because, if he is not, he will not have a title to defend.
"Then, thirdly, if he still wants to box, can he be found fit to fight?
"I certainly do not know the answer to any of those questions at this time."
But Harrison's manager, Hughes, insists the WBO champion will be released on Monday.
He said: "At least now he has a date when he knows he will be walking out the front door of that place.
"That will happen on Monday morning - that is 100 per cent guaranteed."
